Email EmmaProfessionalEducated at Oxford University, Emma was called to the Bar of England and Wales in 2001 and practised from the chambers of 7 Bedford Row. She then qualified as a Jersey Advocate in 2007 and became a partner of the Jersey litigation law firm Baker and Partners in 2010.
ExpertiseEmma specialises in civil and commercial litigation, particularly with an offshore context. She has particular expertise in all aspects of contentious trusts work, including advising beneficiaries on breach of trusts claims, representing trustees in contentious trusts litigation and the misuse of trusts and associated structures. She also specialises in civil fraud work including restitutionary claims, tracing and constructive trust arguments. She is the junior Advocate instructed for the Federal Republic of Brazil in the recovery of $22 million in a civil fraud action involving the former Mayor of Sao Paulo.
Emma has also had significant experience in regulatory law and economic crime. She was appointed as an inspector for the Jersey Financial Services Commission in relation to the investigations into several trust company businesses . She was also one of the team appointed to work alongside the Commission’s enforcement division advising the Malaysian Securities Commission on the repatriation of the proceeds of a fraud on investors, located in Jersey. She has worked alongside trust companies in rehabilitation projects advising on the drafting of policies and procedures.
Emma regularly advises on money laundering issues, suspicious transaction reports, PEP reviews and corporate governance issues for trust company businesses.
Notable cases: AG v Caversham & Bell (the first case prosecuting a breach of the Jersey Money Laundering Order) ; In re the A Trust (changed the Jersey law on mistake); Takilla v Olsen Backhurst & Dorey; Federal Republic of Brazil v Durant International Corp and Kildare Finance Limited.
